Legacy Member Payment & Cancellation Policy
Effective Date: August 1, 2025
Applies To: Members who enrolled in K-Co Finance services prior to August 2025 under the Squarespace billing platform and were subsequently migrated to Stripe for payment processing.
1. Scope & Applicability
This policy governs payment terms, cancellation rights, and applicable fees for legacy K-Co Finance members whose subscriptions originated on Squarespace prior to the platform transition to Stripe. By continuing services after migration, members acknowledge, accept, and agree to be legally bound by the terms outlined herein.
2. Subscription Billing
Membership fees are billed on a recurring monthly or annual basis, depending on the member’s original subscription selection. All payments are processed securely via Stripe following the platform migration. Members are responsible for maintaining a valid payment method on file. Failure to do so may result in suspension or termination of services.
3. Right to Cancel
Members may cancel their membership at any time by providing written notice via email or the designated client portal. Cancellation does not relieve the member of financial obligations incurred prior to or as a result of cancellation.
4. Cancellation Fee
Upon cancellation, members agree to pay a cancellation fee equal to one (1) month of their current subscription rate. This fee applies regardless of billing cadence (monthly or annual) and is intended to compensate K-Co Finance for administrative costs, service planning, reserved capacity, and professional resource allocation. The cancellation fee will be automatically charged to the payment method on file at the time the cancellation request is processed.
5. Service Continuation & Access
Members will retain access to K-Co Finance services through the end of the paid billing period following cancellation. No prorated refunds or credits shall be issued for unused or partially used billing periods.
6. Failed Payments & Collections
If a payment method fails or a charge is disputed, K-Co Finance reserves the right to retry payment processing, suspend services, terminate the account, and pursue collection of any outstanding balances, including applicable cancellation fees. Members are responsible for any costs incurred in connection with collections or chargeback disputes.
7. Survival of Obligations
All payment obligations, cancellation fees, dispute rights, and limitation of liability provisions shall survive termination or cancellation of membership.
8. Non-Waiver
Failure by K-Co Finance to enforce any provision of this policy shall not constitute a waiver of the right to enforce such provision or any other provision in the future.
9. Governing Law & Venue
This policy shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising under or related to this policy shall be resolved exclusively in the state or federal courts located within California.
10. Policy Updates
K-Co Finance reserves the right to amend or update this policy at its discretion with reasonable notice. Continued use of services after such notice constitutes acceptance of the revised terms.
